Trucker and Company Sued by Insurance Company
A truck driver and his company are facing a lawsuit over an accident which occurred in Wayne County. The collision on Interstate 70 claimed the life of a 22-year-old woman nearly one year ago.
State Farm Mutual Automobile insurance seeks $17,000 against the driver, Harvinder Singh Bhagtana. The Fresno-based trucker and his carrier, Ekam Transport Inc., are both facing the suit which was filed by Indianapolis attorney Kevin L. Moyer for State Farm. The suit has been assigned to a Circuit Court.
The driver was piloting a 2015 Volvo heading eastbound on May 22, 106 when he came upon a congested area in the road. A construction project had caused traffic to be backed-up, and the driver ended up striking a blue 2016 Acura MDX driven by Nicholas Berry and sending it upright into the median.
His truck then collided with a stopped 2009 Audi driven by Margaret Ryan. The impact sent the vehicle under the trailer of the semi stopped in front of her.
State Farm had provided coverage for Berry’s Acura which incurred just over $17,000 worth of damages according to the complaint. The suit claims Bhagtana’s negligence led to the accidents that day.
Sal Farragamo was only five vehicles behind the accident. He said: “I saw a blue car going into the ditch and a truck trying to stop, so I stopped. I was doing probably 65 miles per hour or 70 miles per hour. One of the trucks clipped a car, then everything else happened.”
